Modifying Child Support in Washington: When Can You Ask for a Change?

Child support orders in Washington are not set in stone. Life circumstances change, and when they do, parents may need to revisit the terms of their current child support arrangements. Whether you're paying or receiving support, understanding when and how to seek a modification is key to ensuring fairness and stability for your child.


When Can Child Support Be Modified in Washington?


Under Washington law, child support orders may be modified if there has been a substantial change in circumstances or after a certain period has passed. Below are some common scenarios that could justify a modification:


1. Change in Income


A significant increase or decrease in income—due to job loss, promotion, or disability—can be grounds for modification. If a parent can no longer meet the obligations due to involuntary unemployment or reduced earnings, the court may agree to recalculate the support amount.


2. Change in Parenting Time or Custody


If the parenting schedule changes significantly (e.g., one parent takes on more overnight visits or becomes the primary caregiver), the support order may no longer reflect the actual responsibilities and may be subject to modification.


3. Change in Child’s Needs


As children grow, so do their financial needs. Increased medical expenses, educational costs, or special needs may be a valid reason to revisit the support order.


4. Time-Based Review


In Washington, a support order can typically be reviewed every 24 months, regardless of whether a substantial change in circumstances has occurred. This is helpful when the child has aged into a new phase of life or cost-of-living adjustments are needed.


How to Request a Modification


To begin the process, the requesting party must file a petition to modify the child support order with the appropriate court. Documentation supporting the change, such as recent pay stubs, tax returns, or records of medical expenses, should be included.
